In a decision launched late Tuesday night, a federal judge ruled that approximately 29 million Facebook users whose individual details was taken in a September 2018 data breach are not entitled to take legal action against Facebook as a group for damages– but the users might be entitled to require better individual information security at Facebook.

The case is Adkins v Facebook Inc, U.S. District Court, Northern District of California, No. 18-05982

In San Francisco on Thursday night, U.S. District Judge William Alsup stated neither credit tracking expenses nor the minimized value of taken individual details was a “cognizable injury” that supported a class action for damages.

Reuters’ Jonathan Stempel reports:

Alsup also stated damages for time users invested to mitigate harm required customized decisions instead of a single classwide evaluation. Users were enabled to take legal action against as a group to require Facebook to use automatic security tracking, enhance employee training, and inform individuals better about hacking dangers.

Alsup turned down Facebook’s claim that these were unneeded because it had fixed the bug that triggered the breach.

” Facebook’s repeated losses of users’ privacy provides a long-lasting need for guidance,” a minimum of at this stage of the litigation, Alsup wrote.

Enabling a damages class action could have exposed Facebook to a greater overall payout.
